Clouded titles need to be cleared in Will County



Will County has sovereign immunity, and there is a question as to the legality of the County putting a cloud on the title of property where building permits that were not closed, as stated by the Illinois Realtor Association.

Will County not the property owner should be responsible for getting a final inspection. In many cases a contractor got the permit and the property owner assumed that everything was done according to the regulations. The property owner does not realize they have to call for this final inspection. Some property is owned by new people with a clear title at the time of their purchase, but now have a cloud on the title because of County past land use policy. The problem is being rectified according to Land Use staff.

The slightly under 400 properties affected should have the cloud on the titles removed. When the Staff sites life safety it is a means voting members of the Board better be careful of what they do and say. The fact is that a furnace put in 5 years ago must be working or there would have been a problem by now. A door that is working 5 years ago is probably still working. So life safety can be viewed as questionable.

Will County needs to end the discussion and just clear the titles.
